Sky Racing's Star Stable - Terms & Conditions

The Sky Racing Star Stable is an online fantasy stable of thoroughbred horses. The website www.starstable.com.au (the Website) and the Sky Racing Star Stable are operated by Vapormedia Virtual Sports, a business unit of Vapormedia Pty Limited ACN 095 684 067 (Vapormedia), for Sky Channel Pty Ltd ABN 77 009 136 010 (Sky Racing).

1. General Entry

1.1 Entry is open to all residents of Australia aged 18 years and over (the Player(s)).

1.2 Information on how to enter and prizes form part of these conditions of entry (the Conditions of Entry). By entering and/or participating in the Sky Racing Star Stable promotion (the Promotion), each Player fully and unconditionally agrees and acknowledges that these Conditions of Entry and the decision of Sky Racing on all matters relating to this Promotion will be final and binding.

1.3 Directors, officers and employees of, or contractors to, the Tabcorp Holdings Limited (Tabcorp) group of companies, their immediate families and all Tabcorp agencies and companies associated with the Promotion may enter the Promotion but will be not be eligible to be awarded any prizes for participation in the Sky Racing Star Stable. For the purposes of these Conditions of Entry, "Immediate families" means a spouse (including de facto), parent, sibling, child, grandparent, grandchild, or parent in law and includes stepparents and stepchildren and half siblings.

1.4 The Promotion is offered as a free game to all Players.

1.5 Sky Racing reserves the right to limit the number of Players in the Promotion at any time for any reason.

1.6 Any entry that fails to provide all required information may be disqualified. Sky Racing assumes no responsibility for incomplete, late or misdirected entries, or entries received through impermissible or illegitimate channels or for failed, partial or garbled computer transmissions, or for technical failures of any kind. Sky Racing reserves the right to disqualify any entrant submitting an entry which is not made in accordance with the terms of these Official Rules or who does not abide by the website Conditions of Entry.

2. Term of Promotion

2.1 The Promotion will be based upon nominated race meetings between 11:00AM (AEST) on Saturday 6 March 2010 and 11:59PM (AEST) on Saturday 24 April 2010 (the Promotion Period).

2.2 The entry period is from 06:00AM (AEST) Friday 12 February 2010 to 10:00AM (AEST) Saturday 6 March 2010 (the Entry Period).

3. How to Enter

3.1 To enter, Players must first, during the Entry Period, complete the online registration form located on the Website (www.starstable.com.au). There are no charges for registration and all aspects of the Promotion are absolutely free. Once registered, Players will receive their personalised home page, where they are required to:

(a) Choose a nickname, which is also used as their stable name (this name must not be offensive or otherwise objectionable or illegal, in Sky Racing's opinion);

(b) Participate in the selection of a fantasy 10 horse stable (Stable) and one stable jockey to the value of $1,000,000 fantasy dollars;

(c) Play and maintain the Stable in accordance with these Conditions of Entry; and

(d) If they are invited to join a Watch List enter the appropriate details to join that Watch List. (A "Watch List" is a 'mini competition' within the overall promotion where friends, family and colleagues can set up there own individual competition and compete against each other.

3.2 Stables in the Watch List will score points as detailed in these Conditions of Entry. There are no additional prizes for Watch List Groups or winners.

3.3 Watch Lists can be joined in one of two ways:

(a) A Player can use the Watch List page on the Website to create and name a Watch List that other Players can be invited to join. The Player will be included in that Watch List.

Players invited by another Player to join a Watch List will receive an invitation and link to the registration page on the Website for the Sky Racing Star Stable game and once registered, will be automatically added to the Watch List.

(b) A Player can accept an invitation from another Player to join their Watch List using a syndicate code that will be sent to them.

Players can only enter the Promotion once per email address. Under no circumstances can Players enter two or more stables in the Promotion. Players can only join one Watch List.

4. Game Rules and Scoring

4.1 Stable

(a) Players must select a stable of 10 different thoroughbred horses (each a Horse) from a pool of Horses (Stable) determined and ranked by Sky Racing experts (Pool). Each Horse will be categorized and given a dollar value. The Promoter may choose to add Horses to the Pool at its discretion.

(b) A Stable is limited to a maximum value of one million dollars ($1,000,000).

(c) At specified times during the Promotion

Period, a Player may vary the composition of their Stable in accordance with these Conditions of Entry (see clause 4.4 - Trades).

4.2 Races

(a) The Promotion will feature 85 scoring races (Featured Races), to be split into 10 separate race meetings (Race Meetings).

(b) Each Stable will receive a virtual credit (Credit) equal to the dollar value of the prize money awarded to a Horse in that Stable if that Horse wins or runs a place in a Featured Race throughout the Promotion Period.

(c) For all meetings, Stables will be credited with the dollar amount awarded by the race clubs on all races conducted during the Race Meeting (number of races per meeting detailed below).

(d) The dollar value is the amount of actual prize money awarded and does not include the value of BOBS, VOBIS incentives, trophies or rugs.

(e) Following each of Race Meetings, scoring updates will be posted on the Website setting out the number of dollars credited to each Horse and each Stable's progressive total.

(f) In the event that a Player's Horse is scratched from one of the Featured Races, Players are not entitled to replace the Horse in that race (unless they are able to make a trade in one of the Trade Periods).

(g) In the event of a dead heat for any of the positions that attracts prize money, the Stable will be allocated credit equal to the final prize money that the race club allocates to that position.

(h) If a Race Meeting is abandoned or cancelled no credit allocations will be made.

(i) If additional races are scheduled on any of the below ten race days, they will be included in the competition. The number of races at each meeting is correct as at 28/1/2010.

4.3 Stable Jockey

(a) Sky Racing will select a pool of jockeys that will ride during the Promotion Period. Players must select one (1) jockey to accompany their Stable. If the Player's Stable jockey wins one of the Feature Races, the Stable will receive a one hundred thousand dollars ($100,000) bonus Credit per race (the Jockey Bonus).

(b) Note: the Jockey Bonus is based on the Player's selected jockey performance and not on the performance of their Stable of Horses.

4.4 Trades

(a) There will be seven (7) periods (Trade Periods) during the Promotion Period (see details of dates below) where Players can modify their Stable of Horses (Trades). Players can trade no more than two (2) Horses per Trade Period and cannot accumulate Trades. Players can also make one (1) jockey trade per Trade Period.

(b) Each Trade Period allows a Player to exchange two Horses and one jockey in their Stable with a horse and jockey from the Pool (which is not already in the Player's Stable). Trades take effect prospectively, i.e. for races still to be run at the time of the Trade.

(c) Each Stable must retain the stipulated stable number of horses (10 horses), and remain within their one million ($1,000,000) budget at all times.

(d) There will be 7 Trade Periods over the course of the Promotion Period. Below outlines opening and closing times of each Trade Period.

5. Selection of Winners

5.1 Major Prize

(a) At the completion of the Promotion, the Stable that has been awarded the highest aggregate Credit during the Promotion Period will be declared the winner ("Major Prize Winner"). The Major Prize Winner will be determined by the Promoter at Sky Channel Pty Ltd, 79 Frenchs Forest Rd, Frenchs Forest, NSW at 10:00AM (AEST) on Monday 26 April 2010.

(b) In the event of a tie, the Stable with the highest number of first-place finishes will be declared the Major Prize Winner. Should this fail to break the tie, the Stable with the highest number of first and second place finishes will be declared the Major Prize Winner. Where a tie cannot be resolved by any of the means above, the Player whose Star Stable entry was registered the earliest in time will be declared the Major Prize Winner.

5.2 Minor Prizes

(a) There will also be weekly minor prizes awarded ( the Minor Prize(s)).

(b) At each Weekly Prize determination (the details of which are provided in clause 5.2 (c) below) the Player that was awarded the most Credit (when compared to other Players) over the preceding week will be determined and will receive the Weekly Minor Prize (as detailed in clause 6.1 (b) below).

(c) The winners of the Minor Prize will be determined weekly at 10:00am on each of Monday 8 March 2010, Monday 15 March 2010, Monday 22 March 2010, Monday 29 March 2010, Monday 5 April 2010, Monday 12 April 2010, Monday 19 April 2010 and Monday 26 April 2010 (Weekly Prize Determination) Sky Channel Pty Ltd, 79 Frenchs Forest Rd, Frenchs Forest, NSW.

(d) In the event of a tie, the Stable with the highest number of first-place finishes will be declared the Minor Prize Winner. Should this fail to break the tie, the Stable with the highest number of first and second place finishes will be declared the Minor Prize Winner. Where a tie cannot be resolved by any of the means above, the Player whose Star Stable entry was registered the earliest in time will be declared the Minor Prize Winner.

(e) Minor Prize winners will be notified by phone and/or email by 6pm on the day of the respective Weekly Prize Determination.

6. Prizes

6.1 There are three Major Prizes and eight (8) Minor Prizes (collectively referred to as Prizes).

(a) Major Prizes

1st Prize: The Player who manages the Stable that has been awarded the most Credit during the Promotion Period will win:

• If NSW TAB Account holder:
o Ten million (10 million) Number 1 Club Reward Points (where 1 reward point equals $0.0025). Reward Points can be redeemed for rewards and privileges through the Number 1 Club website - www.numberoneclub.com.au; and
o a Sky Racing merchandise pack valued at $30.00 (including GST).
• If not a NSW TAB Account holder:
o Two thousand ($2,000) cheque; and
o a Sky Racing merchandise pack valued at $30.00 (including GST)

2nd Prize: The Player who manages the Stable that has been awarded the second highest amount of Credit during the Promotion Period will win:

• If NSW TAB Account holder:
o Three million (3 million) Number 1 Club Reward Points (where 1 Reward Point equals $0.0025). Reward Points can be redeemed for rewards and privileges through the Number 1 Club website - www.numberoneclub.com.au; and
o a Sky Racing merchandise pack valued at $30.00 (including GST).


• If not a NSW TAB Account holder:
o One thousand dollar ($1,000) cheque; and
o a Sky Racing merchandise pack valued at $30.00 (including GST).


3rd Prize: The Player who manages the Stable that has been awarded the third highest amount of Credit during the Promotion Period will win:

• If NSW TAB Account holder:
o Two million (2 million) Number 1 Club Reward Points (where 1 Reward Point equals $0.0025). Reward Points can be redeemed for rewards and privileges through the Number 1 Club website - www.numberoneclub.com.au; and
o a Sky Racing merchandise pack valued at $30.00 (including GST)


• If not a NSW TAB Account holder:
o Five hundred dollar ($500) cheque; and
o a Sky Racing merchandise pack valued at $30.00 (including GST).


Total Maximum Major Prize Pool (1st, 2nd and 3rd place getters are NSW TAB account holders) $37,590

Total Minimum Major Prize Pool: (1st, 2nd and 3rd place getters are not NSW TAB account holders): $3,590

(b) Minor Prizes

At each Weekly Prize Determination, the Player that was awarded the most Credit (when compared to other Players) over the preceding week will be determined and will receive:

• If NSW TAB Account holder: o Four hundred thousand (400,000) Number 1 Club Reward Points (where 1 Reward Point equals $0.0025). Reward Points can be redeemed for rewards and privileges through the Number 1 Club website - www.numberoneclub.com.au; and o a Sky Racing merchandise pack valued at $30.00 (including GST)

• If not a NSW TAB Account holder: o One hundred dollar ($100) cheque; and o a Sky Racing merchandise pack valued at $30.00 (including GST).

Total Maximum Minor Prize Pool (All weekly winners are NSW TAB Account holders): $8,240

Total Minimum Minor Prize Pool (All weekly winners are not NSW TAB Account holders): $1,040

Total Maximum Prize Pool: $45,830

6.2 Costs

All other costs associated with the Prizes, including but not limited to any meals (not specified), taxes, insurance, travel to and from participants' home and the nominated airports and other ancillary costs are the responsibility of the Prize winners.

6.3 Prize Specific Conditions

(a) All Prizes (both Major and Minor) are inclusive of GST and Sky Racing takes no responsibility for any variations in the value of the Prize.

(b) If Prizes are unavailable, for whatever reason, the Promoter reserves the right to substitute the Prizes for Prizes of equal or greater value, subject to state regulation.

(c) All Prizes must be taken as offered and cannot be varied. Prize values are GST inclusive.

(d) All Prizes must be taken on the dates specified only.

(e) Except as provided for in clause 12 of these Conditions of Entry, in the event that for any reason whatsoever the Major Prize winner does not take an element of the Major Prize at the time stipulated by the Promoter then that element of the Major Prize will be forfeited by the Major Prize winner and cash will not be awarded in lieu of that element of the Major Prize.

(f) Unless otherwise advised in these Conditions of Entry, all other costs associated with the redemption of the Prizes are the responsibility of the Prize winners.

7. Major Prize Winners Notification

7.1 The Major Prize winners will be notified by phone and in writing, using the details provided in their entry, and the name and suburb of the Major Prize winners will be announced on the Website. The Major Prize winners will be published in the in the Australian on Friday 30 April 2010.

7.2 The Minor Prize winners will be notified by phone and in writing, using the details provided in their entry by 6:00pm (AEST) on the Monday of their respective weekly prize determination.

8. Tax Statement

Any taxes which may be payable as a consequence of the Winner receiving the Prizes are the sole responsibility of the Winner. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial and tax advice should be sought.

9. Exclusion of Liability

9.1 To the extent permitted by law, the Promoter is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by the Promoter or their servants or agents, in connection with this Promotion or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to a Player or a Prize winner.

9.2 Nothing in these Conditions of Entry affect, nor is intended to affect, any rights that a Player might have that are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servants or agents for breach of any such rights is limited to the supplying of the relevant goods or services again.

10. Use of Personal Information / Marketing

10.1 Any entries become the property of the Promoter. Any information Players provide will be used by the Promoter for the purpose of conducting this Promotion.

10.2 The Promoter may disclose Players' personal information to its contractors and agents to assist in conducting this Promotion or communicating with Players.

10.3 By entering the Promotion, Players consent to their personal information being collected, used and disclosed by the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion, and business partners for any promotional activities, including the Player's personal participation in reasonable promotional activities as requested by the Promoter, and any marketing and publicity purposes without any further reference, payment or other compensation to the Player.

10.4 Players' consent includes authorising the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion and business partners to send the Player future electronic messages including but not limited to, SMS, MMS, and email regarding any promotional, marketing and publicity activities.

10.5 Players' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at its address set out below.

10.6 All Players consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in reasonable Promotion activities as requested by the Promoter.

11. General Conditions

11.1 The Promoter, its employees, officers, agents, and its parent companies and subsidiaries are not responsible for and shall not be liable for:

(a) any condition caused by events beyond the control of the Promoter that may cause the game to be disrupted or corrupted;

(b) any injuries, losses (including, without limitation, loss of profits), or damages of any kind (even where resulting from negligence of the Promoter or any other person) caused by the Prizes or resulting from acceptance, possession, use, or misuse of the Prizes, or from participation in the Promotion or downloading material from the Website; or

(c) any printing or typographical errors in any materials associated with the Promotion.

11.2 The Promoter reserves the right, in its sole discretion, to:

(a) cancel or suspend the Promotion, should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Promoter, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Promotion;

(b) disqualify any Player who engages in offensive, illegal or objectionable conduct;

(c) disqualify any individual who tampers with the entry process, or who submits an entry that is not in accordance with these Conditions of Entry and, subject to any written directions given by any relevant government or regulatory authority, to cancel, terminate, modify or suspend the Promotion;

(d) request the winner provide proof of age, identity or proof of residency at the nominated Prize delivery address.

11.3 In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.

11.4 It is a condition of accepting the Prizes that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

11.5 To the extent that a situation or issue arises for which these Conditions of Entry make no provision or in relation to which the relevant Conditions of Entry are unclear, the Promoter also reserves the right to make a decision regarding such situation or issue in its sole and absolute discretion and such decision will be final and binding.

11.6 In the event that a winner is identified as a minor, self excluded patron, involuntarily excluded patron or any other person who is in breach of these Conditions of Entry, the Promoter reserves the right to refuse to allow the winner to take part in, or receive, any or all aspects of the Prizes, and the Promoter will notify any relevant regulator accordingly where required by law to do so.

11.7 Decisions of the management of the Promoter are final. No correspondence will be entered into.

12. Unclaimed prize Determination

12.1 If the Major Prize is not claimed within three (3) months after the completion of the Promotion, the Major Prize will be awarded to the Player which finishes in second position. This will take place at 10.00 AM (AEST) on Monday 26 July 2010 at Sky Channel Pty Ltd, 79 Frenchs Forest Rd, Frenchs Forest, NSW subject to any written directions.

12.2 If Minor Prizes are not claimed within three (3) months after the completion of the Promotion, an unclaimed prize Determination will be conducted at 10.00 AM (AEST) on Monday 26 July 2010 at Sky Channel Pty Ltd, 79 Frenchs Forest Rd, Frenchs Forest, NSW subject to any written directions.

12.3 Winner's names will be announced in the Australian on Friday 30 July 2010.

13. The Promoter
